International Humanitarian Law and International Human Rights Law seem to be and sound like almost one and the same thing but in real sense they are completely different in the way they function. However, in the process of their functioning, they are bodies which complement each other in terms of the law sector. Each and every one of them works separately as an independent entity or rather body but at the end of it all, the results that are achieved are connected towards a common goal of ensuring that humanity and rights of the people are observed in the world. The two bodies are always concerned with protecting the life, peoples' health, as well as the dignity of those people. The independence in the two bodies comes in that International Humanitarian Law (IHL) is applied in the armed conflicts while on the other hand, human rights law is applied at all times and works to make sure that internationally there is dignity, health and that the lives of citizens internationally are protected in times when there is war and or conflicts and even when peace is prevailing.
International Humanitarian Law
This law is a law that operates in a large number of countries in the world. It was set up and meant to work with other laws that existed so that dignity, health and the security of lives for citizens is ensured. Basically it is always put to work when there are armed conflicts within or between all the countries that are involved. By so doing, the livers of the citizens in all the involved countries is secured and protected from any kind of harm.
There are a number of provisions found in this law which specify what exactly should happen or take place when armed conflicts occur in the countries. For example, this humanitarian law specifies about the movement of people and how it should be restricted at such times. When it happens that there is an outbreak of an armed conflict, this law is enforced by the military and it should be followed by all the classes and groups of people within the specific countries which are victims of this conflict. Those who fail to honor what this law requires are then dealt with in a lawful manner whether they are the normal citizens or the even the military itself. For instance, an instance where this law is employed is where a curfew is declared in the countries by the various authorities where each and every one adheres to the guidelines which are stipulated.
The measures that are taken to make sure that the citizens are able to follow the humanitarian law are that the government arrests those who risk their lives and those of others at times of attack. Fines are then applied to the people who have defied the law so that at any given time they don't go against what is provided by the law to protect them and ensure that peace prevails among all the people and that clashes are solved in the countries in a lawful manner. However, when it comes to the military's role to ensure that this law is at work in times when clashes have arisen, the military in this case is expected and restricted by this law to make sure that they control the way they handle the citizens or even those who break the humanitarian law. On the other hand, the nations are restricted to follow the humanitarian law and then make sure that they mobilize their citizens so that international clashes between them and other countries that involve the use of arms does not directly or indirectly pose threats to the lives of the people.
International Human Rights Law
The international human rights law is the other law that works internationally with the other laws that have been in place so that security of people's lives s ensured. Unlike the international humanitarian law, the international human rights law is not just applied during specific times. Instead, it is a law that works in the diverse nations at all times. This law prevails during seasons when there is peace in the countries, when warfare arises, when there are clashes and by this, it fosters unity and stability in all the people of the countries.
Countries follow this law under all the circumstances. The way it works is that there are various lifetime regulations that it puts on the lives of the people. These regulations are actually the ones that are used to show what is perceived as wrong or even as a crime and that anyone who goes against what the law expects them is dealt with.
Despite the laws bodies working independently, the core goal which they are always aimed at achieving is the protection of the peoples lives. They will all work to make sure that the people of all the nations or rather countries involved bear and show the necessary dignity, ensure that there is peace under good or bad circumstances and make sure that people remain healthy at all the times.a
